Website and Ballot Terms & Conditions

This Website ("Website") and the ballot for the Queensferry Crossing Experience is produced and run by Scottish Ministers, acting through Transport Scotland, and GSi Events Limited (together referred to as "We" or "us").

These terms and conditions apply to all visitors and users registering on the Website and those who make a ballot application. If you do not agree with any of the following terms and conditions of use you must not use the Website or make a ballot application.

Privacy Policy

We are committed to protecting your privacy. We will only use the information that We collect about you fairly and lawfully (in accordance with the Data Protection Act 1998).

We will collect and process the following data about you: information about you that you give us by opening a Queensferry Crossing Experience account and submitting a ballot application or by corresponding with us by phone, e-mail or otherwise. It includes information you provide when you register to use the Website and if you report a problem with the Website. The information you give us may include your name, date of birth, address, e-mail address and mobile phone number.

Information We collect from you will be stored on our internal systems and our Website will verify you as a ballot entrant for the purposes of the Queensferry Crossing Experience event. We will never collect sensitive information about you without your explicit consent.

You are responsible for ensuring that the information We hold about you is correct and up to date. You can check and manage the information that We hold about you by logging into your Queensferry Crossing Experience account.  Your Queensferry Crossing Experience account will remain active until 1st November 2017.

You must not share your username and password with any person. Responsibility for the security of your password rests with you. You agree to accept responsibility for all usage and activities that occur under your Queensferry Crossing Experience account and you should let us know immediately if you believe that your password has become known to anyone else, or if the password is being, or is likely to be used in an unauthorised manner. We shall not be liable to any person for any loss or damage that may arise as a result of your failure to keep your password and account protected.

The personal information that We hold will be held securely in accordance with our internal security policy and the law. We may use technology to track the patterns of behaviour of visitors to the Website but will not collect any personally identifiable information when doing this.

We will collect and use information about you for the following purposes:

  • To process the opening of your Queensferry Crossing Experience account and your ballot application;
  • To send newsletters about the event you have entered. You cannot opt-out of this before the event if your ballot application is successful and you confirm your place as one of the event participants as the newsletters will contain information about the event.
  • To inform you of any special offers or products in relation to the event.
  • To send you updates regarding the status of your ballot application and event status.
  • To allocate you to a travel hub and departure time if your ballot application is successful.
  • To understand the behaviour of our registered users.
  • If your ballot application is successful, your details will be subject to Police Scotland checks in advance of the event. This is to ensure the safety of all participants and staff for the duration of the event.
  • When you enter this event We need to know your name, email address, postal address and date of birth. This allows us to process your entry and notify you of the status of your entry.

Privacy Policy changes

If We decide to change our privacy policy, We will post those changes on this page so that you are aware of what information We collect, how We use it and under what circumstances We disclose it.

Content Disclaimer

We seek to ensure that the information on this Website is up to date and accurate. However, We shall not be in any way liable for any damage, loss, costs or expenses arising directly or indirectly from the downloading of any of the contents from the Website, or its reliance on or use of any of the contents for any purpose.

We shall not be liable in any way for any damage, loss, costs or expenses arising directly or indirectly from the use of the content of this Website for any purpose.

We may from time to time alter any aspect of the Website as we think fit and without notice. It is your responsibility to check regularly to determine the Website has been changed.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Website or any content on it, whether express or implied.

We will not be liable to any user for any loss or damage, whether in contract, delict (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  2. use of or reliance on any content displayed on our Website.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Website or to your downloading of any content on it, or on any website linked to it.

The Ballot

Participation in the Queensferry Crossing Experience event can only be achieved by submitting a ballot application via this Website and that ballot application being successful in the ballot draw.

In order to submit a ballot application, you must first create a Queensferry Crossing Experience account on this Website.

To register for the Queensferry Crossing Experience you must be 16 years old or older on the day of the ballot closing.

Only one ballot application is permitted per person. Attempts to submit multiple applications will result in deletion of all applications of the individual along with any additional applications made by the individual as part of their group.

The ballot for the Queensferry Crossing Experience will be drawn using an automated random selection process performed using a computer algorithm that looks purely at the database identifiers of each entrant and is blind to their personal information. Each entrant will have an equal chance of being successful in the ballot regardless of when they entered the ballot, where they live or any other personal information.

Successful ballot applicants will receive a text message and email to alert them to their successful status at which point they will have 48 hours to book their experience via their Queensferry Crossing Experience account.

If a successful ballot applicant does not book their experience within the allocated 48 hour period, they will lose their successful status and will revert to having an unsuccessful status and will be added to the waiting list.

Unsuccessful ballot applicants will be notified of their status by email and will be added to the waiting list. If they are selected from the waiting list and promoted to having a successful status they will be notified by text message and email.

Participation

Each participant in the event must have their own Queensferry Crossing Experience account. An email address and mobile number is required for all participants. All correspondence will be via email and text.

Each participant in the event must adhere to the terms of the conditions of the event. By submitting a ballot application, you agree to adhere to the terms and conditions of the event. A copy of those terms and conditions can be found here.

Governing Law

These terms and conditions are governed by and shall be construed in accordance with Scots law and subject to the jurisdiction of the Scottish courts.


Queensferry Crossing Experience Terms & Conditions

Scottish Ministers, acting through Transport Scotland, and GSi Events Limited (together referred to as "We" or "us") are responsible for the Queensferry Crossing Experience (the "Event").

If you participate in the Event, you agree to adhere to these terms and conditions.

Use of your data for event security

When you submitted your ballot application, you provided your name, email address, postal address and date of birth. All Event participant's details will be subject to Police Scotland checks in advance of the event. This is to ensure the safety of all participants and staff for the duration of the Event.

Participation

Any participant in the Event under the age of 16 years old on the day of the Event must be accompanied by an adult.

Each participant must bring photographic identification and their Queensferry Crossing Experience security pass on the day of their Queensferry Crossing Experience. Without these, participants will not be permitted to take part in the Crossing.

Participants must wear appropriate clothing and footwear for the Event.

On the Queensferry Crossing Experience

Participants must follow instructions as given from the Queensferry Crossing Experience ambassadors throughout the duration of the day.

All participants are expected to conduct themselves in a professional and courteous manner during their participation in the Event. Anyone violating this rule of conduct shall be asked to leave the Event.

Each participant shall be provided with a Queensferry Crossing Experience security pass in advance of the day of the Event. This pass must be worn at all times during your participation in the Event.

To allow the Event to run to time, participants who are late to arrive to their pre-allocated travel hub should not expect the coaches to wait for them.

No persons are authorised to take part in the Event unless they are registered participants. No person shall be allowed to accompany a participant if he / she is not registered on the Event.

Access to the Queensferry Crossing is via the pre-allocated travel hubs only. Participants are not permitted to make their own way to the Queensferry Crossing.

Participant Safety

Skateboards, Nordic sticks, rollerblades, bicycles or any similar wheeled devices are not permitted on the Event.

Participants are recommended not to wear devices plugged into the ear whilst participating in the Event for health and safety reasons. When you wear such a device you are unable to hear other participants or ambassador instructions.

Medical personnel authorised by the Event may examine any participant who appears in distress. If in the sole opinion of authorised medical personnel it is in the best interest of the participant"s health and welfare, medical personnel may remove the participant from the Event.

Participants are responsible and assume liability for any and all medical expenses incurred as a result of participation in the Event, including but not limited to ambulance transport, hospital stays, physician and pharmaceutical goods and services.

Photography

We may arrange for photographs and/or video footage to be taken at the Event and used for promotional purposes. This may include printed documents or media, editorial coverage, advertising press and use on the internet.

Cancellation Policy

We reserve the right to cancel the Event in the case of extreme weather which may put participants safety at risk (gale force winds, flash floods, blizzards). This decision will be made at the discretion of the Event Director. We will contact participants via email and text to let them know about any cancellation.

If the Event is cancelled, We will not be liable for any expenses incurred by any participant in anticipation of the Event.

Liability

All participants take part in the Event at their own risk, waiving all claims against Scottish Ministers and any party acting on their behalf.

To the fullest extent permitted by law, We will not be liable for any loss, damage, death or injury howsoever caused unless it is a direct result of negligence.

Amendments

The Queensferry Crossing Experience administrators reserve the right to modify, supplement or waive all or part of the Event rules.

Participants shall be bound by any modification or supplement of the Event rules published prior to the Event.

Governing Law

These terms and conditions are governed by and shall be construed in accordance with Scots law and subject to the jurisdiction of the Scottish courts.
